PRIVACY POLICY
1. Privacy Policy
From time to time, Qponchicago.com (referred to herein as "Qpon" "we" "us" and "our") may request certain personally identifying information from all of its users ("you" or "your"). Maintaining the privacy of your personally identifying information is a high priority. Therefore, we have created this Privacy Policy to cover the Qpon website ("Site" and "Qponchicago.com") and to outline the ways Qpon will use your personally identifying information obtained when you (i) visit Qponchicago.com; (ii) create an account with Qponchicago.com; or (iii) purchase products and/or services through Qponchicago.com. You accept the practices and terms contained in this Privacy Policy by visiting Qponchicago.com. This Privacy Policy may be updated to conform with innovations to the Qpon business model. Please continuously review this Privacy Policy for modifications. Your use of the Site after incorporation of any updates is your acceptance of those updates.
2. The Qpon Method for Collecting and Using Your Information
(a) Personal Information. When you visit Qponchicago.com, register with the Site, and/or correspond with Qpon, you may voluntarily provide your first and last name, telephone number, email address and zip code (collectively referred to herein as "Personal Information"). If you choose not to provide your Personal Information, you may not be able to use all of the features available on Qponchicago.com.
(i) Name. Most Qpon products/services will be provided with a quick response (QR) code which you (or the participating merchant at time of purchase) can download through smart phone technology. Qpon may require you to provide the full name of the party redeeming Qpon products or services - whether that be the purchasing party or a third party to whom the product or service is transferred (the "Qpon Recipient")to confirm authenticity of payment and to personalize future correspondence.
(ii) Email Address. Qpon will utilize your email address to provide you with email updates, respond to your email inquiries, communicate with you subsequent to the transaction process, and/or provide you with other services. Qpon may provide your email address to third parties pursuant to Section 4 below. You may notify Qponchicago.com if you do not wish to receive email updates. At any time after registration you may terminate communication with Qpon by clicking on "unsubscribe" on the bottom of every email from Qpon and follow the prompts. As an alternative method, you may also unsubscribe by contacting Qponchicago.com at customerservice@qponchicago.com.
(b) Cookies. Qpon uses cookies to identify your browser and website navigation patterns and preferences. Qpon uses two forms of cookies: session cookies and persistent cookies. Session cookies track your preferences based on a single visit to Qponchicago.com and persistent cookies allow Qponchicago.com to remember your preferences on subsequent visits. Both session and persistent cookies are valuable in order to improve your overall experience with the Site and provide Qpon with information to enhance our services. You can refuse, block, and/or disable cookies at any time, but doing so prevents Qpon from providing you with the most effective services.
(c) General Use Statistics. Qpon tracks user trends that do not require the analysis of your Personal Information. Instead, Qpon retains certain general use statistics, including: number of visits to our website; time spent on our website; frequently viewed pages on the Qpon site; type of browser used; and overall patterns of Qpon web site use. Web beacons are utilized to increase the effectiveness of our communication with you by providing Qpon with information about when you have received and read Qpon email updates. Qpon may collect your internal protocol address to assist with website administration, for ad targeting, and to detect fraudulent activity.
(d) Social Media. Although not available at this time to Qpon users, you may have in the future the opportunity to log onto the Site through social media such as Facebook and/or Twitter ("Social Media"). Through doing so, you will allow Qpon access to certain Personal Information stored within your Social Media profiles. You may limit the Personal Information obtained by Qpon from your Social Media profiles.
3. How QPON Secures the Privacy of Your Personal Information
Qpon is committed to the security of your Personal Information. All commercially reasonable safeguards and administrative protections are implemented by Qpon to secure your Personal Information. When you register or log in to Pay Pal to purchase your Qpon product/service, Pay Pal will confirm that your browser is running Secure Socket Layer 3.0 (SSL) or higher, which gives you the maximum possible protection. All of your information is protected by Pay Pal's SSL, with an encryption key length of 168 bits—the highest level commercially available. Your personal information is stored on Pay Pal's servers and heavily guarded, both physically and electronically. Pay Pal does not directly connect its firewall-protected services to the Internet.
4. Sharing your Personal Information with Third Parties
(a) Third parties. Qpon will share your Personal Information with Pay Pal but not with other third parties including, without limitation, Qpon Merchants.
(b) Transfer. In the event Qpon chooses to reorganize our business structure or merge with another company, Qpon may transfer your Personal Information to continue providing you with products and/or services.
(c) Required disclosure. Qpon may be required to disclose your Personal Information in the following scenarios: in accordance with the law; to detect and address certain fraudulent activities associated with your account; to protect the rights of Qpon; in emergency situations; and to provide services beneficial to you.
(d) Personal Information sales. Qpon will not sell or otherwise let others, not listed in this Section 4, use your personally identifying information.
5. Links to Third Party Websites
Qpon may elect to include links to third party websites on the Site, but Qpon cannot control the privacy policy or operations of third party websites. Third party websites may contain privacy policies, which you should review for your own benefit. While it is convenient for you to use the links provided on Qponchicago.com, the links do not suggest Qpon's endorsement, compliance, security, or affiliation with the third party website and you access third party websites at your own risk.
6. Notice to California Residents
Pursuant to California Civil Code Section 1798.83, if you are a resident of the state of California and use Qpon, you may request (a) Personal Information obtained about you by Qpon; and (b) a list of third parties that received your Personal Information with the names and address of the third parties and examples of products marketed by the companies. To request either of the above, write a letter identifying your name, address and email address to Qpon Life, LLC, 1900 S. Prairie Avenue, Chicago, Illinois 60616. Please note that Qpon will retain copies of certain transactional information in the event the company is audited.
7. Minors
You must be eighteen (18) years of age or older to use Qponchicago.com (or the age of majority in your state/province/country of residence). Qpon does not direct its content or knowingly target children under the age of eighteen (18). If Qpon becomes aware a user is under the age of thirteen (13) we will immediately remove all of that user's Personal Information.
8. Updating Your Personal Information
Qpon makes a good faith effort to maintain accurate records of all data. You may contact Qpon at any time to update and/or modify your Personal Information at customerservice@qponchicago.com.
